Informations sur l’élagage et l’entretien des arbres

Informations importantes : suite à des événements récents, un petit rappel sur l’élagage et l’entretien des arbres en bordure des routes départementales et communales.

Qui est concerné par l’élagage ?

Les propriétaires riverains, dont arbres et haies sont plantés en bordure de voies départementales, communales et chemins ruraux, sont dans l’obligation de procéder à l’élagage des branches, ou à l’abattage des arbres morts qui menacent de tomber.

Pourquoi faut-il élaguer ?

Pour la sécurité de chacun. L’objectif consiste à prévenir la chute d’arbres et de branches sur les véhicules et personnes empruntant les voies de communication. Cela permet également une meilleure visibilité pour le voisinage et pour le réseau routier, d’éviter le dysfonctionnement des infrastructures, comme les lignes aériennes, téléphoniques et électriques, ou l’interruption d’une voie de circulation. Enfin, cela évite la dégradation des routes par les arbres, les branches et les racines qui avancent sur les voies.

Que dit la loi ?

Les arbres, arbustes, haies, branches et racines qui avancent sur le sol des routes communales doivent être coupés à l’aplomb de ces voies sur une hauteur de cinq mètres, et doivent, en outre, être élagués régulièrement afin de ne pas toucher les réseaux aériens (téléphone et électricité). Ces opérations d’élagage sont à la charge des propriétaires ou de leurs représentants.

Responsabilité du propriétaire des plantations :

Les propriétaires de plantations qui dépassent de leur propriété en sont civilement responsables. En cas de dommage, leur responsabilité civile pourra être engagée (articles 1382 et suivants du Code civil). Cette responsabilité peut être mise en jeu tant par la commune que par les administrés qui s’estiment lésés.

Who is concerned by pruning?

Riverside owners, whose trees and hedges are planted on the edge of departmental, municipal and rural roads, are obliged to prune the branches, or the felling of dead trees that threaten to fall.

Why do you need to prune?

For everyone’s safety. The objective is to prevent the fall of trees and branches on vehicles and people using the communication routes. This also allows better visibility for the neighbourhood and for the road network, to avoid the malfunction of infrastructures, such as overhead, telephone and power lines, or the interruption of a traffic lane. Finally, it avoids the degradation of roads by trees, branches and roots that advance on the roads.

What does the law say?

Trees, shrubs, hedges, branches and roots that advance on the ground of municipal roads must be cut plumb from these roads over a height of five metres, and must, in addition, be pruned regularly so as not to affect the air networks (telephone and electricity). These pruning operations are the responsibility of the owners or their representatives.

Responsibility of the plantation owner:

Plantation owners who exceed their property are civilly responsible. In the event of damage, their civil liability may be incurred (Articles 1382 et seq. of the Civil Code). This responsibility can be jeosted both by the municipality and by the administered who consider themselves agged.

Wie heeft er te maken met het snoeien?

Oevereigenaren, waarvan bomen en heggen langs provinciale wegen, gemeentelijke wegen en landelijke wegen worden geplant, zijn verplicht om takken te snoeien of dode bomen die dreigen om te vallen, te kappen.

Waarom moet er gesnoeid worden?

Voor ieders veiligheid. Het doel is om te voorkomen dat bomen en takken omvallen op voertuigen en mensen die de verkeerswegen gebruiken. Dit zorgt ook voor een beter zicht voor de buurt en voor het wegennet, waardoor storingen in infrastructuur, zoals bovengrondse, telefoon- en elektriciteitslijnen, of het onderbreken van een rijbaan worden voorkomen. Tot slot voorkomt het degradatie van wegen door bomen, takken en wortels die over de wegen komen.

Wat zegt de wet?

Bomen, struiken, heggen, takken en wortels die op de grond van de gemeentelijke wegen uitsteken, moeten over een hoogte van vijf meter loodrecht van deze wegen worden gekapt, en moeten bovendien regelmatig worden gesnoeid om de bovengrondse netwerken (telefoon en elektriciteit) niet te raken. Deze snoeiwerkzaamheden zijn voor rekening van de eigenaren of hun vertegenwoordigers.

Verantwoordelijkheid van de eigenaar van de plantages:

Deze aansprakelijkheid kan zowel door de gemeente als door de burgers die zich benadeeld voelen, op het spel worden gesteld.
